EncoreBon Platform
1. Acceptance of Terms
By accessing or using the EncoreBon mobile application ("App") and services ("Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the App or Services.
EncoreBon is a surplus food marketplace platform operating in Tunisia that connects vendors selling surplus food items with consumers seeking discounted food products.
2. Definitions
- "Platform" or "EncoreBon" refers to the EncoreBon mobile application and related services.
- "User" refers to any individual who accesses or uses the App.
- "Vendor" refers to businesses or individuals who list and sell food items through the Platform.
- "Purchase" refers to a transaction between a User and a Vendor facilitated through the Platform.
- "Food Item" refers to surplus food products listed for sale by Vendors.
3. Platform Nature and Role
3.1 Marketplace Platform
EncoreBon operates as a marketplace platform that facilitates transactions between Vendors and Users. EncoreBon is NOT a food retailer, food producer, or direct seller of food items.
3.2 Platform Responsibilities
- EncoreBon provides the technological infrastructure for Vendors to list food items and for Users to discover and purchase them.
- EncoreBon facilitates communication between Users and Vendors.
- EncoreBon processes purchase transactions and provides purchase verification codes.
- EncoreBon does NOT handle, store, prepare, package, or deliver food items.
3.3 Vendor Responsibilities
- Vendors are solely responsible for the quality, safety, freshness, and edibility of all food items they list and sell.
- Vendors are responsible for accurately describing food items, including expiration dates, storage conditions, and any allergens.
- Vendors are responsible for ensuring food items comply with all applicable Tunisian food safety regulations.
- Vendors set their own prices and are responsible for pricing accuracy.
4. Food Safety and Liability
4.1 Food Quality and Safety
IMPORTANT: All food items sold through the Platform are surplus food products. By using the Platform, Users acknowledge that:
- Food items are sold "as-is" based on Vendor descriptions.
- EncoreBon does NOT inspect, verify, or guarantee the quality, safety, or edibility of any food item.
- Users are responsible for inspecting food items upon pickup and determining their suitability for consumption.
4.2 Vendor Liability
Vendors are solely and exclusively responsible for:
- Ensuring all food items are safe for consumption and comply with Tunisian food safety standards.
- Accurately representing food items, including expiration dates, storage requirements, and condition.
- Any illness, injury, or health complications resulting from consumption of food items sold through the Platform.
- Any misrepresentation, contamination, or quality issues with food items.
- Compliance with all applicable laws and regulations regarding food sales.
4.3 Platform Limitation of Liability
EncoreBon, as a marketplace platform, is NOT liable for:
- Food quality, safety, freshness, or edibility issues.
- Foodborne illnesses or health complications.
- Misrepresentation by Vendors.
- Disputes between Users and Vendors regarding food quality or condition.
- Any damages, losses, or injuries resulting from consumption of food items purchased through the Platform.
4.4 User Remedies
If a User experiences any issues with a food item purchased through the Platform:
- Users must contact the Vendor directly to resolve the issue.
- Users may report issues to EncoreBon support, but EncoreBon's role is limited to facilitating communication.
- Users may only pursue legal action against the Vendor, not against EncoreBon.
- EncoreBon may, at its discretion, assist in dispute resolution but is not obligated to do so.
4.5 Agreement Between EncoreBon and Vendors
Vendors agree that all food items listed on the Platform must be:
- Safe for consumption and compliant with Tunisian food safety regulations.
- Accurately described, including expiration dates and storage requirements.
- Still edible without any complications at the time of sale.
- Properly stored and handled according to food safety standards.
If any complications arise from food items sold through the Platform, the Vendor is solely responsible and liable for all damages, injuries, and legal consequences.
5. Authentication and Data Collection
5.1 Google Authentication
When you choose to sign in using Google authentication, EncoreBon collects the following information from your Google account:
- Google User ID (`sub` or `id`): Unique identifier from Google
- Email Address: Your Google account email
- Full Name: Your display name from Google
- Given Name (First Name): Your first name
- Family Name (Last Name): Your last name
- Profile Picture URL: URL to your Google profile picture
Purpose: This information is used solely for:
- Creating and managing your EncoreBon account
- Authenticating your identity
- Personalizing your experience within the App
- Internal app analytics and platform improvement
Data Usage: EncoreBon does NOT sell, rent, or share your Google authentication data with third parties. This data is used exclusively for internal app operations and analytics.
5.2 Facebook Authentication
When you choose to sign in using Facebook authentication, EncoreBon collects the following information from your Facebook account:
- Facebook User ID: Unique identifier from Facebook
- Email Address: Your Facebook account email (if provided)
- Full Name: Your display name from Facebook
- First Name: Your first name
- Last Name: Your last name
- Profile Picture URL: URL to your Facebook profile picture
Purpose: This information is used solely for:
- Creating and managing your EncoreBon account
- Authenticating your identity
- Personalizing your experience within the App
- Internal app analytics and platform improvement
Data Usage: EncoreBon does NOT sell, rent, or share your Facebook authentication data with third parties. This data is used exclusively for internal app operations and analytics.
5.3 Device Information
For security and fraud prevention purposes, EncoreBon collects device information including:
- Device ID/Model: Device identifier and model information
- Operating System: OS name and version
- App Version: Version of the EncoreBon app you are using
- Device Brand and Model: Manufacturer and device model
- Device Type: Type of device (phone, tablet, etc.)
- IP Address: Internet Protocol address (collected at device registration)
- Device Fingerprint: Cryptographic hash of device characteristics
Purpose: Device information is used for:
- Security monitoring and fraud detection
- Preventing unauthorized access to accounts
- Legal and forensic purposes if necessary
- Internal analytics to improve app security and performance
Storage: Device information is stored securely and is retained for security and legal compliance purposes. Up to 5 devices per user are tracked.
6. Data Usage and Analytics
6.1 Internal Analytics Only
All data collected by EncoreBon is used exclusively for internal app analytics to:
- Improve app functionality and user experience
- Monitor app performance and identify technical issues
- Analyze user behavior patterns to enhance features
- Ensure platform security and prevent fraud
- Comply with legal and regulatory requirements
6.2 Data Sharing Policy
EncoreBon does NOT:
- Sell your personal data to third parties
- Rent or lease your data to advertisers or data brokers
- Share your authentication data with external parties (except as required by law)
- Use your data for purposes unrelated to Platform operations
6.3 Third-Party Services
EncoreBon uses third-party services (Google, Facebook) for authentication. Your use of these services is also governed by their respective privacy policies:

7. Advertisements
7.1 Custom Advertisement System
EncoreBon displays custom advertisements within the App. These advertisements are:
- Custom ads created specifically for the EncoreBon platform
- Displayed in designated areas of the App (Explore screen, Food Details screen)
- Geographically targeted based on your city location (if provided)
- Shown using weighted distribution algorithms
7.2 Advertisement Tracking
When you view or interact with advertisements, EncoreBon tracks:
- Impressions: Number of times an ad is displayed to you
- Clicks: Number of times you click on an ad
- Geographic Data: Your city location (for geographic targeting)
- Placement: Which screen the ad appeared on
Purpose: This tracking is used for:
- Measuring advertisement effectiveness
- Improving ad targeting and relevance
- Internal analytics and reporting
- Ensuring fair ad distribution
Data Usage: Advertisement tracking data is used exclusively for internal analytics and is NOT sold to third parties.
7.3 Advertisement Content
- EncoreBon is not responsible for the content, accuracy, or claims made in advertisements.
- Advertisements may contain links to external websites. EncoreBon is not responsible for external website content or privacy practices.
- Users interact with advertisements at their own discretion and risk.
8. Account Deletion and Data Suppression
8.1 Right to Delete Account
You have the right to request deletion of your EncoreBon account at any time by:
- Using the account deletion feature in the App settings
- Contacting EncoreBon support at contact@encorebon.com
8.2 Data Suppression Process
When you request account deletion, EncoreBon performs a soft deletion (data suppression) process:
- Account Status: Your account is marked as inactive (`is_active = False`)
- Access Blocked: You will no longer be able to access the App or your account
- Label Deletion: Your account label/display name is removed from public view
- Active Purchases Cancelled: All active (pending) purchases are automatically cancelled
- Purchase Cancellation Effects:
- Cancelled purchases trigger normal cancellation procedures
- Strikes may be applied according to the strike system (see Section 9)
- Food item quantities are restored to Vendors
8.3 Data Retention
Important: After account deletion:
- Account Data Preserved: Your account record is retained in the database
for:
- Legal and regulatory compliance
- Fraud prevention and security purposes
- Historical transaction records
- Dispute resolution
- Personal Information Suppressed: Your personal information (name, email, etc.) is suppressed from active use
- Purchase History Retained: Historical purchase records are retained for legal and accounting purposes
- Device Information Retained: Device fingerprints and security data are retained for security purposes
8.4 Hard Deletion Limitations
Users with purchase history CANNOT be hard-deleted (permanently removed from the database) due to:
- Legal requirements for transaction records
- Accounting and tax compliance
- Fraud prevention and security
- Dispute resolution needs
If you have made purchases through the Platform, only soft deletion (suppression) is available.
8.5 Data Deletion Requests
For specific data deletion requests beyond account deletion, contact EncoreBon support. EncoreBon will comply with applicable data protection laws, including:
- Right to erasure (where legally required)
- Data minimization principles
- Legal retention requirements
9. Ban and Strike System
9.1 Purpose
EncoreBon implements a ban and strike system to:
- Prevent abuse of the Platform
- Ensure fair use of the Platform by all Users
- Maintain platform integrity and trust
- Protect Vendors from fraudulent or abusive behavior
9.2 Strike System
Strikes are issued for:
- Late Cancellations: Cancelling a purchase after the cancellation deadline
- Post-Pickup Cancellations: Cancelling a purchase after pickup has occurred
- Admin Penalties: Violations of Platform rules or terms of service
Strike Accumulation:
- Every 3 strikes = 1 heart lost
- Users start with 2 hearts (configurable by admin)
- Hearts represent your standing on the Platform
9.3 Ban Types
9.3.1 Temporary Ban (15 Days)
- Trigger: 1st or 2nd strike (losing 1 heart)
- Duration: 15 days from the date of the strike
- Effect: Account access is blocked during the ban period
- Recovery: Automatic after 15 days (if you have remaining hearts)
9.3.2 Permanent Ban
- Trigger: 3rd strike (all hearts lost, `hearts = 0`)
- Duration: Permanent (until admin intervention)
- Effect: Account access is permanently blocked
- Recovery: Only possible through admin restoration of hearts
9.4 Ban Effects
When a ban is active:
- Account Access: You cannot log in or use the Platform
- Active Purchases: All active purchases are automatically cancelled
- Purchase Cancellation: Cancelled purchases follow normal cancellation procedures
- Strikes Applied: Cancellations due to bans may result in additional strikes
9.5 Ban Appeals
If you believe you were banned in error:
- Contact EncoreBon support at contact@encorebon.com
- Provide details of your situation
- EncoreBon will review your case and may restore access at its discretion
Note: EncoreBon reserves the right to ban accounts for violations of these Terms, Platform rules, or applicable laws, with or without prior notice.
10. Purchases and Transactions
10.1 Purchase Process
- Users browse food items listed by Vendors
- Users select items and quantities
- Users complete purchases through the Platform
- Users receive a purchase verification code
- Users pick up food items directly from Vendors using the verification code
10.2 Payment Methods
- Cash on Pickup: Payment is made directly to the Vendor upon pickup
- Other Methods: Additional payment methods may be available as determined by EncoreBon
10.3 Purchase Verification
- Each purchase generates a unique verification code
- Vendors verify codes to mark purchases as complete
- Users must present the code to Vendors for pickup
10.4 Cancellation Policy
- Users may cancel purchases within the allowed cancellation window
- Late cancellations or post-pickup cancellations result in strikes (see Section 9)
- Cancelled purchases restore food item quantities to Vendors
10.5 Disputes
- Disputes regarding purchases should be resolved directly with the Vendor
- EncoreBon may facilitate communication but is not obligated to resolve disputes
- EncoreBon is not responsible for refunds or purchase-related issues
11. User Responsibilities
11.1 Account Security
- You are responsible for maintaining the security of your account
- You must not share your account credentials with others
- You must notify EncoreBon immediately of any unauthorized access
11.2 Accurate Information
- You must provide accurate information when creating your account
- You must keep your account information up to date
- You are responsible for the accuracy of information you provide
11.3 Prohibited Activities
You agree NOT to:
- Use the Platform for any illegal purposes
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Harass, abuse, or harm other Users or Vendors
- Attempt to circumvent Platform security measures
- Use automated systems to access the Platform without authorization
- Interfere with Platform operations or other Users' use of the Platform
11.4 Compliance with Laws
- You must comply with all applicable Tunisian laws and regulations
- You are responsible for any legal consequences of your use of the Platform
12. Vendor Responsibilities
12.1 Food Safety
Vendors are solely responsible for:
- Ensuring all food items are safe for consumption
- Complying with Tunisian food safety regulations
- Accurately describing food items and their condition
- Proper storage and handling of food items
- Any health complications resulting from food items sold
12.2 Accurate Listings
Vendors must:
- Provide accurate descriptions of food items
- Include correct expiration dates and storage requirements
- Set accurate prices
- Maintain adequate inventory levels
- Update listings promptly when items are sold out
12.3 Transaction Fulfillment
Vendors must:
- Honor all purchases made through the Platform
- Verify purchase codes accurately
- Provide food items as described in listings
- Handle pickup transactions professionally
13. Intellectual Property
13.1 Platform Ownership
- All content, features, and functionality of the Platform are owned by EncoreBon
- The EncoreBon name, logo, and branding are trademarks of EncoreBon
- You may not use EncoreBon's intellectual property without written permission
13.2 User Content
- You retain ownership of content you submit to the Platform
- By submitting content, you grant EncoreBon a license to use, display, and distribute your content on the Platform
- You are responsible for ensuring you have the right to submit any content you provide
14. Limitation of Liability
14.1 Platform Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- EncoreBon is NOT liable for any indirect, incidental, special, or consequential damages
- EncoreBon's total liability is limited to the amount you paid for purchases through the Platform in the 12 months preceding the claim
- EncoreBon is NOT liable for food quality, safety, or health issues (see Section 4)
14.2 Service Availability
- EncoreBon does not guarantee uninterrupted or error-free service
- EncoreBon may suspend or terminate services at any time
- EncoreBon is not liable for service interruptions or technical issues
14.3 Third-Party Services
- EncoreBon is not responsible for third-party services (Google, Facebook, payment processors)
- Your use of third-party services is subject to their terms and conditions
- EncoreBon is not liable for issues arising from third-party services
15. Indemnification
You agree to indemnify and hold harmless EncoreBon, its officers, directors, employees, and agents from:
- Any claims arising from your use of the Platform
- Your violation of these Terms
- Your violation of any laws or regulations
- Your infringement of any intellectual property rights
- Any disputes between you and Vendors
16. Termination
16.1 Termination by User
- You may terminate your account at any time (see Section 8)
- Termination does not affect your obligations under these Terms
16.2 Termination by EncoreBon
EncoreBon may terminate or suspend your account:
- For violation of these Terms
- For illegal or fraudulent activity
- For abuse of the Platform
- At EncoreBon's discretion, with or without notice
16.3 Effect of Termination
Upon termination:
- Your access to the Platform is revoked
- Active purchases may be cancelled
- Data retention policies apply (see Section 8)
17. Dispute Resolution
17.1 User-Vendor Disputes
- Disputes between Users and Vendors should be resolved directly
- EncoreBon may facilitate communication but is not obligated to resolve disputes
- Users may only pursue legal action against Vendors, not against EncoreBon
17.2 Platform Disputes
- Disputes with EncoreBon should first be addressed through support: contact@encorebon.com
- If unresolved, disputes will be governed by Tunisian law
- Jurisdiction: Tunisian courts
18. Modifications to Terms
18.1 Changes to Terms
- EncoreBon may modify these Terms at any time
- Material changes will be notified through the App or email
- Continued use of the Platform after changes constitutes acceptance
18.2 Review of Terms
- You are responsible for reviewing these Terms periodically
- The "Last Updated" date indicates when Terms were last modified
19. General Provisions
19.1 Entire Agreement
These Terms constitute the entire agreement between you and EncoreBon regarding the Platform.
19.2 Severability
If any provision of these Terms is found invalid, the remaining provisions will remain in effect.
19.3 Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
19.4 Assignment
You may not assign these Terms without EncoreBon's written consent. EncoreBon may assign these Terms at its discretion.
19.5 Language
These Terms are provided in English. In case of conflict with translated versions, the English version prevails.

21. Acknowledgment
By using the EncoreBon Platform, you acknowledge that:

- You understand that Vendors are solely responsible for food quality and safety
- You understand that you may only pursue legal action against Vendors, not against EncoreBon
- You understand the data collection, usage, and suppression policies
- You understand the ban and strike system
If you do not agree to these Terms, you must not use the EncoreBon Platform.
